The updated .au Domain Administration (auDA) Terms of Endorsement were today released by The Hon Paul Fletcher (Minister of Communications etc).

To be eligible to register an .org.au in Australia, the simple premise is that you must be a not-for-profit organisation.

In what is welcome news for domain investors, registrants and entrepreneurs, a 3 Member WIPO Panel has just unanimously decided in favour of the legitimate Registrant of this generic domain name. This was despite a Complainant (with deep pockets) instructing Minter Ellison to go after the domain.

One of the biggest changes regarding Australian domain names is due to come into force next Monday – 12th April 2020. There are to be new licensing rules that will affect the registration and renewal of Aussie domains.
My experience over 20 years tells me that there are going to be many registrants that wouldn’t have a clue this is happening. Hence the title of this article. I wonder whether the auDA Board and Management have considered a short amnesty period for registrants to get their “house in order”? It would be a wonderful gesture.

3 Letter domains continue to be acquired by endusers in Australia, and the average price paid for these unique acronym identifiers goes up and up.
Many of these sales go unreported, but Domainer has been informed that the domain FFI.com.au was recently sold by a domain investor for $30,000.

There is no question in my mind that the Covid-19 pandemic has inspired aftermarket domain name sales here in Australia – as it has done around the world.
A lot of people who were suddenly faced with no job had the impetus needed to convert that “idea” they had been thinking about for ages into reality. And for that they needed a good domain name.

In the latest round of international musical chairs (acquisitions and takeovers), Donuts,Inc has acquired Afilias, Inc. Afilias, Inc is the parent company of the Australian Registry Operator “Afilias Australia”. auDA has issued a statement this morning saying that they have “commenced a formal due diligence process to inform its decision regarding consent”.

There is a rort going on, and it involves ineligible entities and people registering .org.au domain names when they are not supposed to. They are not following auDA rules, and the regulator seems to be letting them get away with it.
auDA needs to concentrate their compliance weapons on those doing the most damage.
